James B. Comey Jr. ('82) is being recommended by White House officials for a spot on the "short list" of potential candidates to replace Supreme Court Justice David Souter according to Politico. Mr. Comey served in the George W. Bush administration as Deputy Attorney General from 2003 to 2005.
Mr. Comey is perhaps most notable for his decision not to sign orders authorizing NSA domestic wiretaps when he served as acting Attorney General in 2004 while John Ashcroft was hospitalized. The refusal resulted in a bedside visit by Alberto Gonzales and Andrew Card to Mr. Ashcroft.
Democratic officials believe Mr. Comey is a reliable opponent of national security measures they believe violate Constitutional protections on civil liberties. Following his graduation from William and Mary, Mr. Comey earned his law degree from the University of Chicago Law School in 1985.
According to Politico, a shortlist has not been finalized and President Obama has yet to meet with all potential nominees. President Obama and Democratic leaders in the Senate hope to have the nominee seated by the beginning of the Supreme Court's term in October.

How is it that nobody at William and Mary knows that Comey was the number 2 at the Justice Department? His stand against the warrentless wiretaps is well known enough. (Continued…)
